முதலில் கிளந்தான் சட்டமன்றத்தில் ஷியாரியா சட்டத்தை நிறைவேற்றியதே சட்டப்படி செல்லாது என அந்த மூத்த வழக்குரைஞர் ஓர் அறிக்கையில் கூறினார்.
“அந்தச் சட்டத்தைக் கொண்டுவரும் அதிகாரம் மாநிலச் சட்டமன்றத்துக்குக் கிடையாது. அரசமைப்பின்படி உருவாக்கப்படாத ஒரு சட்டத்தைச் செயல்படுத்த நாடாளுமன்றத்தாலும் முடியாது”, என்றாரவர்.

Justice Datuk S. Augustine Paul, in calling for his defence, said that the prosecution had adduced sufficient evidence to establish a prima facie case against Balwant Singh. MM Focus: Shooting Of Despatch Clerk By Lawyer: It’s justified, say police

“OUR investigations show there is justification”.
Federal Criminal Investigation Department deputy director I Deputy
Commissioner Datuk Musa Hassan told The Malay Mail this yesterday, when
asked to comment on an incident in which a prominent lawyer shot dead a
despatch clerk last Friday.
He was asked whether Datuk Balwant Singh had acted in self-defence when he
shot the victim, R. Gobalakrishnan, 33, who had lunged at the lawyer with
a piece of wood.
The incident followed an argument between Balwant, 83, and Gobalakrishnan.
Musa said the police would submit the investigation papers to “higher
authorities”.
“Depending on the situation, if there is an offence, we will arrest the
culprit.” Later, Gobalakrishnan’s family appealed to witnesses to help
police in the investigations at the MCA public service and complaint
department.
The victim’s sister, R. Kumari, told a Press conference that the family
believed the shooting was unjustified and needed the help of witnesses to
strengthen their case against the lawyer.
On Saturday, the family had gone to the scene of the shooting and claimed
they could not find a tree from which a branch had been broken off.
“How could they claim that my brother used a stick to attack the lawyer
when we cannot find a tree with a broken branch?,” asked Kumari.
She said they were also disappointed that the police did not arrest the
lawyer to facilitate investigations.
It was reported that the incident occurred at 4.45pm along Jalan Maarof in
Bangsar, after the two were involved in a minor traffic altercation near
the central railway station.
Following an argument, Gobalakrishnan was said to have chased the car on a
Honda EX5 motorcycle and blocked its path along Jalan Maarof. Balwant, who
was in a Mercedes Benz C200 driven by a woman believed to be his
daughter-in-law, alighted to confront the motorcyclist.
A heated argument ensued and Gobalakrishnan was alleged to have grabbed a
piece of wood. It was reported that this had allegedly prompted Balwant to
open fire with his revolver.
The Sunday Mail had reported that Gobalakrishnan’s widow, sales promoter
Arokiamary Anthony, 28, intended to file a suit against the lawyer for
causing her husband’s death.
When interviewed, Balwant had said he was in a state of shock but
maintained that he had used his revolver, for which he was licensed to
carry, in self-defence.
On Saturday, city Criminal Investigation Department chief Senior Assistant
Commissioner II Kamaruddin Mat Desa said the case was classified as murder
under Section 302 of the Penal Code.

All Cases To Be Investigated Without Fear Or Favour, Says Rais

KUALA KLAWANG, June 12 (Bernama) — All reported crimes will be
investigated fairly regardless of the position of the persons alleged to
have committed the offences, Minister in the Prime Minister’s Department
Datuk Seri Dr Rais Yatim said Tuesday.
Irrespective of whether it was a Datuk or Tan Sri who was implicated in
the crime, the law would have to take its course as provided for under
Article 184 of the Constitution, he said.
“We need more precise monitoring. For cases already reported, we are
afraid that media treatment or comment can be prejudicial to the facts of
the case. This we have to avoid.
“But once this is taken care of, we have to be firm in implementing the
requirements of the law. Whether it is a case in Bangsar, Kuala Lumpur, or
Johor, we will still study it carefully from the legal aspects,” he told
reporters here.
He said this when asked to comment on the cases of a Datuk allegedly
shooting dead a despatch rider following a traffic misunderstanding in
Bangsar last Friday and a businessman in Johor, a Tan Sri in his
80s,allegedly raping his maid over the last two years.
Dr Rais said it would not be proper for him to comment further on the two
cases.
However, the public had the right to know the status of a case after a
certain period, he said after launching the Jelebu District Teacher’s Day
celebration at Sekolah Kebangsaan Petaseh, near here.
He said the police would submit reports to the Attorney-General and no
aspects of the cases would be covered up.
“I will look into these cases with the Attorney-General,” he said.

Police’s full report to rais on shooting involving Balwant Singh

June 12: Police are expected to give a full report soon to Minister in the
Prime Minister’s Department Datuk Seri Dr Rais Yatim on last Fridays
shooting incident involving lawyer Datuk Balwant Singh.
Rais said he expected to receive the report in a few days time.
“The only report I have is through the media. What should be done now is a
thorough investigation before we can conclude other possibilities.
“This only means that the police and other authorities must co-ordinate
their work which will definitely entail thorough investigations,” he said
when commenting on the incident in which despatch rider R. Gobalakrishnan
was shot dead in what Balwant, 83, claimed is self-defence.
Rais said the Government would not protect VIPs who committed crimes.
“The Government’s stance on this matter is clear. Those who commit crimes,
regardless of their positions and backgrounds, must be investigated
thoroughly.”
Rais said this when asked why Balwant was not detained by police although
the case had been classified as murder which is a non-bailable offence.
Balwant and his daughter-in-law were in their car when the incident
occurred.
The lawyer was released on police bail after he lodged a police report at
the Pantai police station on Friday.
Gobalakrishnan was cremated at the Cheras crematorium at 3pm on Monday.
He was speaking after launching the Jelebu district-level Teachers’ Day
celebration at Sekolah Kebangsaan Petaseh near here.
