Cops abuse the law to intimidate Kita Lawan
IGP acting in contempt of court, says lawyer
Victor Johan: When PKR Padang Serai MP and lawyer N Surendran said that the police was abusing Section 143 of the Penal Code, which only applies to violent assemblies with criminal motive, inspector-general of police (IGP) Khalid Abu Bakar replied that this was just Surendran’s interpretation.
Khalid said: “I am also a lawyer, I also have my own interpretation, Our responsibility is to enforce the existing law, and pass it to the court (for judgment).”
Now, is Khalid supposed to enforce the law and follow the court’s verdict, which the court did not give a stay order, or does Khalid use his own interpretations citing he is also a lawyer?
Mind you, Khalid is not a practising lawyer called to the Malaysian Bar. He leads the Royal Malaysian Police (PDRM), and now he smears the name of the Agong by not abiding the country’s law, judiciary and the constitution.
Khalid should be taken to task for his continuous disgraceful acts.
Hang Babeuf: As noted earlier, the right to hold a peaceful public rally of this kind was upheld by the courts in the case of the post-GE13 Shah Alam events.
The IGP and PDRM are acting in flagrant defiance of the courts and of constitutional principle. Yet they want to investigate others.
This is the ultimate in ‘ketuanan’ delusionism. It is an old joke, but one must ask the question again: PRDM? Polis Raja di Malaysia?
If the IGP does not like the law as the courts have clarified its meaning, then he should proceed with due respect for the law and under the law to have that law changed.
He must not subvert the law, the rule of law and the courts.
Pemerhati: Umno is using the courts and the police to punish the opposition by unreasonably detaining them.
The police and the magistrates have to do what Umno wants them to do because if they do not then their future prospects in the service are affected and they might get transferred to some ulu area.
Kit P: It is definitely an abuse of law to allow the remand for a detainee under a law that a higher court has ruled as unconstitutional.
The government can continue their appeal, but as things stand, the law is unenforceable.
Malaysia Ku: The IGP thinks he is a law unto himself. How many times has he contemptuously ignored the courts’ rulings?
It’s a sad state of affairs in Malaysia with the so-called guardians of the law acting like the Wild West in dispensing their own erroneous take on the law.
But these are the very people that the PM and Umno want as their agents to ensure unfettered rule.
Angel: The IGP is in double contempt of court. First was when he refused to follow or order his men to abide by the Ipoh High Court’s decision to arrest Indira Gandhi’s former husband and return her son to her. Surprisingly, the attorney-general and cabinet allow him to do so.
Now he is trying to be smart (which is not his nature) in not respecting the decision of appellate court.
If you want to execute the law, wait for the Federal Court decision. Indeed, you can be sued for this if the Federal Court upheld the appellate court decision.
Wandering Star: HRH Agong, could you please enlighten us again what you said during the opening of Parliament on Monday?
Perhaps, either you were badly advised by your CEO of the country or your script writer did not do enough research on the abuse of our federal constitution by the rogue government of the day?
Ipohcrite: Nobody is above the law, including the IGP. If the IGP had misused or abused the law, or committed contempt, then he should be hauled up.
But the question is, who is going to arrest him? And even before that, who is to investigate and charge him? He may not be above the law but in Malaysia he may well be untouchable.
Drawn knives behind Umno’s smiles for PM?
Anonymous$&@?: “There would be no cover-up, Najib had pledged.”
Would you trust this PM who also pledged that the Sedition Act will be dissolved? With so many flip-flops under his belt, the rakyat already know that all this is just a ‘sandiwara’ to placate the anger and lost of trust for this leader and hope that everyone will cool down and forget about the 1Malaysia Development Berhad (1MDB) scandal.
Vking: It is too early to make speculation to give a negative picture on the meeting between Umno division chiefs with Najib. But at this moment, the picture is very clear – they support the leadership of Najib to go forward to investigate 1MDB.
Hero325: It is quite clear that the DPM is leading a dissident faction to take over the leadership of the country.
There are a number of Umno ministers sneaking below deck to see which side to support. But at the end of the day, they would support the PM.
Headhunter: Of course, for as long as Najib Razak remained the PM, the hangers-on will stick to him like glue.
But the moment they see him losing power and a challenger is coming their way, the herd mentality will take over and they will abandon Najib like rats abandoning a sinking ship. Just you watch.
